The lawsuit alleges that Apple misleads consumers about the available storage in the iPhone and the iPad by not telling them about the hefty software updates. According to the lawsuit Apple “fails to disclose” to people that as much as 23.1 percent of the advertised storage space on 8 GB and 16 GB devices would be consumed by iOS 8.

Miami residents plaintiffs – Paul Orshan and Christopher Endara are seeking damages and changes to Apple’s policies. It also accuses Apple of not working with third-party storage vendors and desktop file transfer utilities for customers to be able to offload their files. The lawsuit states that Apple is “using sharp business techniques” by pushing out hefty software updates to force users to buy the iCloud space.

Apple has not yet commented on the lawsuit.
